1. Definitions
- “We/our/us” – FlashbackFrames, a sole-proprietorship operated by Sudarshan Tiwari.
- “You/your/customer” – the individual or entity booking a conversion.
- “Event” – a single family function recorded on one calendar date (e.g., full wedding day or one birthday party) regardless of the number of discs.
- “Media” – DVDs, VCDs or CDs you hand over for conversion.
- “Service” – straight digital transfer of your Media to a USB drive; no editing, colour-correction or restoration.
2. Scope of Service
- ₹ 1 199 flat covers one event (all discs from that event) converted to MP4 on a 32 GB USB 3.0 drive and returned with the original discs.
- Additional events: ₹ 1 199 each.
- Turn-around target: Within in a week within Noida / NCR. (Delays caused by strikes, weather or courier issues are outside our control.)
3. Personal-use–only policy
We convert only private, non-commercial recordings (family weddings, birthdays, etc.).
If any disc contains copyrighted or commercial material we will:
Return the disc unconverted, and
Refund the fee allocated to that disc/event.
4. Media condition & readability
- We clean discs and use error-correction drives, but cannot guarantee recovery of damaged or degraded footage.
- Unreadable disc ⇒ we return it and refund full amount
- We do not repair scratches, enhance video or restore lost footage.
5. Pickup, transit & liability
- Discs are packaged in padded envelopes and tracked.
- Physical-damage disclaimer: While we handle media carefully, you agree that FlashbackFrames is not liable for breakage or loss occurring during third-party courier transit.
- If we misplace a disc due to any reason, we are not liable to pay any compensation against misplacement.
6. Payment & refunds
- Full payment (or chosen instalment) is collected at checkout.
- Refunds are processed within 7 business days to the original payment method for:
- unreadable discs (per § 4)
- rejected copyrighted content (per § 3)
- service cancellation before pick-up.
- No refund once conversion is complete and USB delivered.
7. Privacy & data retention
- Staff sign NDAs
- Your files are stored only for QC and customer verification.
- Auto-deletion: all digital copies are wiped 15 days after delivery, unless you purchase extended cloud storage.
8. Customer responsibilities
- Label discs clearly and group them by event.
- Verify the USB contents within 15 days of receipt.
- Keep your own back-ups; we are not an archival facility beyond the stated retention period.
9. Limitation of liability
Under no circumstances shall FlashbackFrames, its owner or agents be liable for indirect, incidental or consequential damages, including loss of emotional value, arising from use of the Service. Total cumulative liability is limited to the conversion fee actually paid for the event in question.
10. Governing law
These Terms are governed by the laws of India. Any dispute shall be subject to the exclusive jurisdiction of the courts of Gautam Buddha Nagar (Noida), Uttar Pradesh.
11. Changes to these Terms
We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the revised Terms.
